Terms of use

These Terms of Service apply to the Formi website, mobile or web application, chat features, recommendations, surveys, and related services made available at www.formiforward.com or through another Formi access point. Formi is operated by The Mindfull Company, Inc. In these Terms, "Formi," "we," "us," and "our" refer to The Mindfull Company, Inc. and the Formi service.

By creating an account, accepting an invitation, or using Formi, you agree to these Terms and the Formi Privacy Policy. If you do not agree, do not use Formi.

These Terms of Service apply to the Formi website, mobile or web application, chat features, recommendations, surveys, and related services made available at www.formiforward.com or through another Formi access point. Formi is operated by The Mindfull Company, Inc. In these Terms, "Formi," "we," "us," and "our" refer to The Mindfull Company, Inc. and the Formi service.

By creating an account, accepting an invitation, or using Formi, you agree to these Terms and the Formi Privacy Policy. If you do not agree, do not use Formi.

What Formi Is

Formi is an AI-based conversation and support tool intended to help adults reflect, stay engaged with personal goals, and identify practical next steps between appointments, meetings, or other sources of support. Formi may offer general wellness suggestions, reminders, educational material, or recommendations based on what you choose to share.

Formi is software. You are not communicating with a human counselor, therapist, peer specialist, sponsor, case manager, physician, or other professional unless the service clearly tells you otherwise. Formi may remember information from earlier conversations to make later interactions more relevant.

Formi is an AI-based conversation and support tool intended to help adults reflect, stay engaged with personal goals, and identify practical next steps between appointments, meetings, or other sources of support. Formi Is Not Therapy, Treatment, or Medical Care

Formi does not provide psychotherapy, counseling, substance use disorder treatment, medical care, diagnosis, clinical monitoring, or professional advice. Use of Formi does not create a therapist-client, clinician-patient, treatment, fiduciary, or other professional relationship with the Company.

Formi is not a substitute for a licensed professional, a treatment or recovery program, medication, a safety plan, or emergency services. Do not start, stop, or change treatment, medication, or a recovery plan based on Formi's responses. Recommendations may be incomplete, unsuitable, or wrong. Use your own judgment and discuss important decisions with a qualified professional who knows your circumstances.

Formi is not an emergency or crisis service. Messages are not guaranteed to be reviewed by a person, and no one is guaranteed to respond or intervene. Do not use Formi to report an emergency or to request immediate help.

If you or another person may be in immediate danger, call 911 or go to the nearest emergency department. If you are in the United States and are experiencing suicidal thoughts or emotional distress, call or text 988 to reach the 988 Suicide & Crisis Lifeline.

Formi may use automated features to identify language that appears to involve self-harm, harm to others, overdose, abuse, or another urgent safety concern and may display crisis resources or other safety information. These features can miss important information and are not a replacement for human assessment or emergency services.

Unless Formi clearly states otherwise, the Company does not supervise that organization or act as its clinician. Information that the organization receives from Formi, if any, will be described at enrollment, in the Privacy Policy, or in a separate notice. Your relationship with that organization is governed by its own agreements and privacy practices.

A treatment provider, recovery program, employer-sponsored program, community organization, or other third party may give you access to Formi. That organization is separate from the Company and remains responsible for its own services, clinical decisions, staff, policies, and legal obligations.

You keep ownership of the messages, feedback, and other material you submit to Formi. You give the Company a limited right to host, process, analyze, reproduce, and use that material as needed to operate, secure, personalize, maintain, and improve Formi; provide support; comply with law; and enforce these Terms.

This permission lasts for as long as the information is retained under the Privacy Policy. It does not give the Company ownership of your personal experiences or ideas. We may create aggregated or deidentified information that does not reasonably identify you and may use that information for product improvement, safety evaluation, research, and business analysis.

Do not submit information that you do not have the right to provide. Avoid including another person's identifying or confidential information unless it is reasonably necessary and you are authorized to share it.

You may not rely on Formi to make clinical, employment, insurance, legal, financial, eligibility, or other high-impact decisions about another person.

The Formi name, logos, and related marks may not be used without our written permission. Nothing in these Terms transfers ownership of the service or Company intellectual property to you.

You may stop using Formi at any time and may request account deletion as described in the Privacy Policy. Sections that by their nature should continue after termination will remain in effect, including ownership, disclaimers, limits of liability, dispute terms, and rights relating to previously created deidentified information.

We may add, remove, or change features; limit access; suspend an account; or discontinue all or part of Formi. We may suspend or terminate access if we reasonably believe you violated these Terms, created a security or safety risk, used the service unlawfully, or exposed the Company or another person to harm or liability.

You may stop using Formi at any time and may request account deletion as described in the Privacy Policy. Sections that by their nature should continue after termination will remain in effect, including ownership, disclaimers, limits of liability, dispute terms, and rights relating to previously created deidentified information.

Indemnification

This section does not require you to reimburse the Company for its own negligence, misconduct, or violation of law.

To the extent permitted by law, you agree to reimburse the Company for reasonable losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your unlawful use of Formi, your material violation of these Terms, or content you submit that violates another person's rights. This section does not require you to reimburse the Company for its own negligence, misconduct, or violation of law.

Informal Resolution, Arbitration, and Class Action Waive

Before filing a claim, you and the Company agree to try to resolve the dispute informally. The person bringing the claim must send a written notice describing the dispute and requested relief. Notices to the Company must be sent to mili@formiforward.com. The parties will have 30 days to try to resolve the matter.

If the dispute is not resolved, either party may require individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. Arbitration may take place by video, telephone, written submissions, or in person in a reasonably convenient location. The Company will pay arbitration fees to the extent required by the applicable rules or law. Either party may bring an individual claim in small claims court instead of arbitration.

Claims must be brought only on an individual basis. Neither party may bring or participate in a class, collective, consolidated, or representative action or arbitration. A court, not an arbitrator, will decide any dispute about the enforceability of this class action waiver.

Your message must include your name, the email address associated with your account, and a clear statement that you are opting out of arbitration. If you opt out, the class action waiver will not apply to you.
